1. Service Description

BPHero is a web application that helps users track and analyze their blood pressure and weight measurements. We are not a medical device or service provider.

2. Medical Disclaimer

BPHero is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician prior to making any changes to your treatment or lifestyle. DEVELOPERS OF THIS SOFTWARE ARE NOT LIABLE FOR ANY ADVERSE MEDICAL OUTCOMES BASED ON YOUR USE OF THE APPLICATION.

3. Privacy & Data Security

• We use third-party authentication and store the minimum information supplied by each authentication provider. We do not store passwords.
• We store your blood pressure, weight readings, and related tags and notes you choose to enter. You can also provide us with your demographic information, at your option.
• We will not share your data with any third parties without your explicit consent. Your health data is used solely to provide you with the BPHero service. We do not use your data for research, analytics, or any other purpose, and we do not share it with other users.
• In the event of a data breach that may affect your personal information, we will notify you as required by applicable law.
• BPHero is not a HIPAA covered entity.
• All customer data is encrypted at rest with AES-256 and in transit via TLS. Our data store vendor (Supabase) is SOC2 compliant. Data is stored in the United States.
• You can export your data, delete your data, or completely erase your account at any time.

4. User Responsibilities

• You agree to use BPHero in a manner consistent with its intent and purpose. We reserve the right to suspend accounts suspected of misuse at our discretion.
• You are responsible for maintaining the confidentiality of your login credentials.

5. Subscription & Payments

BPHero is currently free to use during the Beta period. The Beta version is limited to 1,000 readings and 20 tags per user. We reserve the right to introduce paid plans in the future, with advance notice to existing users.

6. Service Availability, Integrity

We strive to maintain high availability but cannot guarantee uninterrupted access. Occasional maintenance or technical issues may cause temporary service interruptions. While we maintain regular backups, we recommend periodically exporting your data for personal records.

7. Warranty Disclaimer

BPHERO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

8. Governing Law

These terms and your use of BPHero are governed by the laws of the State of California, without regard to its conflict of laws provisions. You agree to submit to the exclusive jurisdiction of the courts located within Los Angeles county.

9. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes through the application.

10. Age Requirement

BPHero is intended for adults aged 18 and older. By using this service, you confirm that you are at least 18 years of age. We do not knowingly collect data from minors.

11. International Users / GDPR

If you are located in the European Economic Area (EEA), United Kingdom, or other regions with data protection laws, you have the right to access, correct, or delete your personal data at any time. To exercise these rights, contact us at support@bphero.com. By using BPHero outside the United States, you consent to your data being transferred to and processed in the United States.
